These Terms and Conditions constitute a legal agreement between you and Producciones Tercera Potencia SAS de CV, trading as Dataztlán, governing your use of the www.mixquac.com website and of the information published on it.
By accessing or using this website you accept these terms. If you do not accept them, you are not authorised to use the site. Where you have signed a separate written agreement with us for a product or service, that agreement prevails over these terms in the event of conflict.

This website describes the company, the technologies it is developing and the products it intends to bring to market, and it lets you register interest in early access or in a partnership conversation.
This website serves exclusively as an informational resource and hosts no user accounts. Using it creates no commercial relationship between us beyond the handling of any enquiry you choose to send.
04Forward-looking statements
This site describes technologies at different stages of development. Roadmap items, target performance figures and planned capabilities are stated as such and are not offers, commitments or representations that a product exists, performs as described, or will become available on any particular date.

Nothing in these terms is intended to, or will, limit our liability for fraud, gross negligence or wilful misconduct, or for death or personal injury caused by our negligence.
To the fullest extent permitted by law and subject to the paragraphs above, you agree that the total aggregate liability of Dataztlán and its affiliates to you for any claim arising out of or relating to these terms or your use of this website will not exceed the greater of (a) the amount you paid us in the three months immediately preceding the event giving rise to the claim, or (b) MXN $5,000, or its equivalent in local currency.
12Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless Dataztlán and its directors, agents, affiliates and representatives against any claim, cost, proceeding, demand, loss, liability, damage, judgment, penalty, interest or expense, including reasonable legal fees, arising out of or relating to (a) any actual or alleged breach by you of these terms, (b) your improper or unlawful use of this website, (c) your violation of any third-party right, including privacy, publicity or intellectual property rights, and (d) your violation of any applicable law or regulation.

Where a change is material we will give reasonable notice on the site, and your continued use after it takes effect constitutes acceptance.

14Governing law and jurisdiction
These terms are governed by and will be construed in accordance with the laws of México.
You agree that the competent courts of Ciudad de México will have exclusive jurisdiction to resolve any dispute arising out of or relating to these terms or your use of this website, including its breach, termination or invalidity. Before submitting a dispute to a court, you agree to work with us first to resolve the matter through good-faith negotiation.
